A Manchester music venue will be back in court next week as a row over noise levels continues, more than two years after the initial complaint was made. Night & Day Café in the Northern Quarter was served a legal notice by Manchester council in November 2021.
It followed a complaint from residents living in a neighbouring flat who have since moved out. TheOldham Street business appealed the noise abatement notice, launching a high-profile campaign, claiming that its survival is at stake if it loses in court.
Several court hearings have taken place so far, starting in November 2022, but the case has been repeatedly adjourned. More acoustic testing has been carried out at the venue since the last court date which was set for July but was derailed as last-minute talks took place.

However, the talks held at the town hall ended with no agreement being reached. Manchester council says it remains committed to settling the case 'amicably' and remains hopeful for a 'positive resolution' once its concerns about noise are addressed.
In a statement posted on social media, Night and Day (N&D) said: "We head back to Manchester Magistrates Court on Monday for our final three-day hearing. We’re hoping to remove the Noise Abatement Notice (NAN) MCC Environmental Health Officers served on us over 2 years ago. The NAN relates to a single noise complaint from a resident who purchased an adjoining flat during lockdown.
"We maintain the source of the problem is that when the adjoining building was converted from warehouse to flats, no consideration was given to the pre-existing live music venue. Attenuation of ‘noise’ was and still is a condition of the planning consent.
