Private care homes would be subject to freedom of information law under Labour plans to shed light on “secret Scotland”.
Families would be given a “right to know” about care standards and how homes are run in the wake of the deadly pandemic.
Labour MSP Katy Clark, who is behind the proposal, said: “In the aftermath of the tragic events of the pandemic, it is clear that the public’s enforceable right to access information must be extended.”
But Donald Macaskill of Scottish Care, which represents private homes, said some of his members could consider legal action if the plan was enacted. FOI provides Scots with a right to information from hundreds of taxpayer-funded bodies.
Campaigners believe the pioneering legislation has not kept track of changes in the delivery of public services. In a speech today, Scottish Labour leader Anas Sarwar will back an extension to FOI to all bodies that provide services like health and education.
One element will be ensuring FOI applies to care homes in the private and voluntary sectors that receive public money.
Covid ripped through the sector in the early days of the pandemic, resulting in thousands of deaths. Tight restrictions on visiting relatives also left families and service users feeling powerless.
If agreed by the Scottish Government, care homes would have 20 days to answer questions and could only refuse if the information was exempt.
Clark, who will launch a consultation later this month, said: “FOI was one of Labour’s greatest achievements in coalition government.
