Supreme Court Unanimously Rules in Favor of Transgender Immigrant

The Associated Press. Despite finding her account of the harms she suffered “credible,” an immigration judge denied her application for asylum on the grounds that she failed to provide sufficient evidence proving that she had faced persecution due to her transgender status.The judge noted, in that decision, that attitudes within Guatemala have changed over time, especially in urban or more cosmopolitan areas, and suggested she could relocate elsewhere within Guatemala, citing Santos-Zacaria’s own admission, under cross-examination, that societal mores have changed, albeit slowly, since she first fled.Santos-Zacaria appealed the judge’s decision, and the Board of Immigration Appeals reversed part of the judge’s findings, finding that she had established evidence of past persecution, but had not given enough evidence to suggest she would face future persecution in her home nation if deported back to Guatemala. Her lawyers argued that the BIA should have remanded the case back to the lower court, rather than issuing its own findings of fact. Santos-Zacaria then appealed to the 5th U.S.

Thania Garcia Oscar Isaac and Gaby Moreno pay homage to their Guatemalan roots with a stripped-down rendition of the classic waltz anthem, “Luna de Xelajú.” The lead single off Moreno’s upcoming album arrived Friday alongside a music video directed by Diego Contreras (Fireland) which sees the two guitarists and singers performing the track in one take at the Palace Theater in Los Angeles. “‘Luna de Xelajú’ is considered the 2nd anthem of my country, Guatemala. Written by Paco Pérez in the 1940s,” explains Moreno. “I’ve been singing it since I was a teenager and more recently have been performing this song live in my concerts, usually as an encore. I invited my dear friend and incredible artist, Oscar Isaac, to sing it with me for this very special acoustic version…Just two voices with two guitars, singing together this timeless, sweet, and nostalgic song from our motherland.”

Naman Ramachandran Sri Lanka’s Vimukthi Jayasundara and Guatemala’s César Díaz, winners of the Cannes Golden Camera for “The Forsaken Land” (2005) and “Nuestras madres” (2019) respectively, are among the recipients of the Hubert Bals Fund (HBF) of the International Film Festival Rotterdam‘s (IFFR) HBF+Europe: Minority Co-production Support scheme for 2022. Out of 25 applications, six projects by filmmakers from Argentina, Egypt, Guatemala, Singapore, Sri Lanka and Yemen have been awarded a contribution of €60,000 ($60,854) each through their European co-producers in Austria, Belgium, France, and the Netherlands. Jayasundara is supported for “Turtle’s Gaze on Spying Stars” (France/Sri Lanka, House on Fire), set on a mysterious resort where the protagonist must quarantine and reckon with his past on his return to Sri Lanka, while Díaz gets it for “Fidelidad” (Guatemala/Belgium, Lemming Film Belgium), a love triangle set on Lake Atitlán in Guatemala.

John Hopewell Chief International CorrespondentHaving focused since 2016 on emerging film talent in lesser-known parts of South and South East Asia, Open Doors, the Locarno Festival’s flagship co-production forum and talent incubator, is turning its focus to Latin America and the Caribbean. Of the 24 directors featured at this year’s edition, 15 identify as female or gender non conforming, led by Ecaudor’s Ana Cristina Barragán whose 2016 debut “Alba” won nods at Rotterdam and  San Sebastián and Yanillys Pérez whose documentary “Jeffrey” scooped a Discovery Awards at the Toronto Festival. Both have new projects at the Open Doors Co-Production Hub, as does Yashira Jordán with “Diamond,” a coming of age tale about a Quechua trap artist last glimpsed at Málaga this year.  Men directors take in Michael Labarca a winner at Cannes’ Cinéfondation film school shorts competition in 2016, and Guatemala’s Mauricio Escobar whose “Los Invisibles” is a social realist tale wrapped around the phenomenon of domestic migration in Guatemala. It is set up at La Danta, whose partners include Cannes 2019 Camera d’Or winner César Díaz (“Our Mothers”).Also selected for Open Doors’ Co-Production Hub, a platform for feature-length projects looking for international collaboration, is Guaraní language “Kokue,” the fiction feature debut of Paraguay’s Miguel Aguëro, based on his memories of growing up in the Paraguayan countryside.

The Guatemalan Congress voted to ban same-sex marriages on Tuesday, March 8.The Conservative-dominated congress passed the “Life and Family Protection Law” by 101 to eight votes. The law also sentences women to a minimum of five years in prison for seeking an abortion and bans the teaching of sexual diversity in schools which it defines as “promoting in children and teenagers policies or programs that tend to lead to diversion from their sexual identities at birth.”The law goes on to state that teaching “anything other than heterosexuality is normal” is prohibited. Congressman Walter Felix, left-wing opponent of the law, said, “The human rights of significant parts of the population are being violated.” In order to be passed into law, it must be signed by Guatemalan President Alejandro Giammattei.Lucrecia Hernández, a lawmaker opposed to the law, stated that the “law stigmatizes people, discriminates and foments intolerance and hate speech and crimes.” She has urged Giammattei to veto it. Conservative Giammattei is expected to approve the law.© Star Observer 2022 | For the latest in lesbian, gay, bisexual, transgender, queer and intersex (LGBTIQ) news in Australia, be sure to visit
