Scotland’s highest legal watchdog has been slammed or its mishandling of complaints over sex text lawyer Brian McConnachie.
The Faculty of Advocates has now been ordered to pay compensation to a rape victim who reported the top KC for misconduct over sex texts sent to her from a court building.
In a damning report, the Scottish Legal Complaints Commission (SLCC) said the faculty failed to properly investigate McConnachie, who boasted to the woman on WhatsApp he would have sex with Sandy Brindley, the chief executive of Rape Crisis Scotland, “just to have something over her”.
He also sent the woman a sexually explicit photo from the toilets of Livingston High Court just after he had represented a rape accused.
In another text, he referred to a client as a “lying c***” .
The commission said the decision-making of the faculty’s complaints committee wasn’t “a fair and thorough examination of all the evidence” and was “unsatisfactory”.
The woman who reported McConnachie said taking on Scotland’s legal elite was a “Herculean task” and welcomed the report criticising the process.
The woman, a rape victim, said the mishandling of her complaint left her so stressed she almost withdrew from the process. She said: “The faculty behaves like a boys’ club and I felt the complaints committee prioritised protecting its own reputation over getting to the truth. I lost all confidence in them and almost gave up.”
