A woman has to give her ex-husband her lottery jackpot winnings as part of their divorce row - after trying to keep the win secret. Denise Rossi scooped 1.3 million but did not tell husband of 25 years Thomas Rossi about the win.
She filed for divorce 11 days later but had decided to leave her soon-to-be ex in the dark over the windfall. He discovered the truth years after their 1996 divorce, when he received a a letter from a company that paid lump sum transitions for lottery winnings.
Addressed to Denise, his then-ex-wife, it stated they had "helped hundreds of lottery winners like you around the country receive a lump-sum payment for the present value of their future annual lottery payments".
As reported by The Mirror, a court heard Denise got the original cheque sent to her mother's address. At the time, she claimed the win and divorce were a coincidence, saying she had "wanted to get out of this relationship for years".
Thomas claimed he was "blindsided" and "confused" and in 2004 told PEOPLE: "She wanted me to move out of the house very fast. It wasn’t like her to act this way.".
The ex-husband secured an injunction a few days after discovering the incriminating letter and took Denise to court, where a judge ruled she had violated laws disclosure of assets and funds and acted in fraud or malice over the $1.3 million jackpot.
Denise, of California, was ordered to pay her ex-husband, then 65, 20 annual instalments of $66,800, amounting to the value of her entire win, writes news.com.au.
Connolly Oyler, Denise’s lawyer, said she may been able to hold onto the winnings had she been honest about them. He told reporters at the time: "I could have argued successfully that it was her separate property.
