Umbro has won a High Court trademark battle with a rival sportswear firm over its famous 'double diamond' logo. Manchester-based Umbro sued online footwear brand Dream Pairs for infringing the trademark of its emblem, which has been used on sports kits since the early 70s.
Dream Pairs uses a diamond logo with a 'P' shaped loop set at a 45 degree angle at its centre. A judge had initially ruled Umbro's trademark hadn't been infringed as there was 'at most a very low degree of similarity' between the two logos.
But the historic firm, which supplied England's 1966 World Cup winning strip, appealed against that ruling, arguing that when seen while being worn, the two logos were easily confused. London's Appeal Court heard that Dream Pairs began selling trainers, football boots and hiking boots sporting the logo in 2019.

Sales, which are carried out mainly through Amazon, had been 'moderate', with about 11,000 pairs sold up to 2022. Umbro, which was founded in Wilmslow in 1924 by brothers Harold and Wallace Humphreys and now has its headquarters in the Northern Quarter, sold more than $180m worth of products between 2016 and 2018, the court heard.
The judge in the original case said there were 'multiple variances' between the two logos, which meant there was 'no likelihood of confusion'. But sitting at the High Court Lord Justice Arnold, Lord Justice Birss and Lady Justice King disagreed.
The judges said the Dream Pairs logo would most likely be viewed while being worn and would 'appear foreshortened'. "Furthermore, the viewer might well not see the sign side-on, but only from the front or rear," they wrote.
