But Aamer Anwar thinks the legal system in Scotland is a mess. The Crown Office is “shambolic”, he opposes juryless trials and fears the lack of Legal Aid is preventing important cases being heard.
He was speaking ahead of a new eight-part series for BBC Scotland, The Firm, in which cameras are allowed behind the scenes as he works with families fighting for justice within a legal framework he fears is badly flawed.
He told the Sunday Mail: “They need a platform to have stories told. I’m sick of the partisan situation in Scotland. I’m not in any political camp, I fight for my clients. Humza Yousaf happens to be my friend but I’ll put friendship to the side. He is getting a kicking off me and will continue to get one. He’s decimating our legal system.”
Last week Anwar, 55, was at court for the review of Sean Hogg’s rape conviction in 2018. Hogg was convicted of raping a 13-year-old girl and sentenced to 270 hours of unpaid work.
There is now a review at the Court of Criminal Appeal in Edinburgh to see if the Crown Office made mistakes. Anwar is representing the young woman and her family in this case which he said underlines that rape trials need juries.
Hogg’s sentence came from the judge, Lord Lake. He said if Hogg had been over 25, he would have got four or five years in jail. For Anwar, this shows the pitfalls of the Scottish Government’s plan to introduce juryless trials: “As my client said, the jury did its job.”
