The Justice Secretary has ordered an independent inquiry into the circumstances and handling of Andrew Malkinson’s case after his conviction was quashed by the Court of Appeal last month.

More than 70,000 people have signed a petition launched by Andrew Malkinson. It is demanding an apology from the independent body that investigates potential miscarriages of justice after it twice rejected his case.
In January, the Criminal Cases Review Commission (CCRC), did refer the case to the Court of Appeal after new DNA testing requested by them revealed a potential alternative suspect. But it had previously refused to do so in 2012 and again in 2020.
Last week Mr Malkinson had his 2004 conviction for a brutal rape in Salford quashed by Court of Appeal judges. But it took him 20 years to clear his name and he spent 17 years in jail.

Mr Malkinson was 37 when he was found guilty on February 10, 2004, by a 10-2 majority of carrying out a violent sex attack on a mum-of-two by the M61 motorway in Little Hulton. He was jailed for life with a minimum term of seven years and remained in prison for a further 10 because he maintained he was innocent.
Last week as he walked from the Royal Courts of Justice, Mr Malkinson delivered a dignified speech, but at times his fury came to the surface. He took aim at the Criminal Cases Review Commission and, GMP who he branded "liars" for their handling on the case.
In its ruling the Court of Appeal said it had “no doubt” that new DNA evidence implicating another suspect rendered Mr Malkinson’s conviction unsafe.
Responding to the decision, GMP issued an apology stating Mr Malkinson “is the victim of such a grave miscarriage of justice, in being convicted of a crime he did not commit and serving a 17-year custodial sentence”.
