Alec Baldwin’s ‘Rust’ Documentary Footage From Rory Kennedy Will Not Be Turned Over to Prosecutors

Gene Maddaus Senior Media Writer A New Mexico judge on Friday denied Alec Baldwin‘s second attempt to throw out his manslaughter indictment, finding that it should be up to a jury to decide if his recklessness led to the death of cinematographer Halyna Hutchins. Baldwin is due to face a trial in Santa Fe beginning on July 9.

Alec Baldwin’s involuntary manslaughter trial next month for the fatal 2021 shooting of Rust  cinematographer Halyna Hutchins is still on, a New Mexico judge ruled today. Judge Mary Marlowe Sommer also decided that the indie Western’s convicted armorer Hannah Gutierrez-Reed does not have to testify at the actor/producer’s trial.

Gene Maddaus Senior Media Writer Alec Baldwin‘s lawyers have filed a fourth motion to throw out his manslaughter indictment, alleging that the prosecutor withheld exculpatory evidence showing that his Colt .45 revolver was damaged at the time of a fatal accident. Baldwin’s defense accuses prosecutor Kari Morrissey of improperly withholding an expert’s report showing “unexplained toolmarks” on the gun’s sear — the portion of the trigger that holds the hammer in place. Baldwin is accused of pointing the gun at cinematographer Halyna Hutchins and firing while setting up for a scene in October 2021.

Rico Priem, 66, was driving home around 4:30 a.m. when his SUV drifted off the 57 freeway, hit a tree, went up an embankment, and flipped over.

Gene Maddaus Senior Media Writer Prosecutors in the Alec Baldwin trial intend to argue that the actor displayed a pattern of recklessness with firearms on the set of “Rust” before the fatal shooting of the film’s cinematographer. In a filing on Monday, prosecutors Kari Morrissey and Erlinda Johnson alleged that Baldwin fired a blank round at a crew member while using the crew member to establish a line of sight. The prosecutors also accuse Baldwin of engaging in “horseplay” with a revolver during training, and allege that he was “erratic and aggressive” during filming, which raised safety concerns.

Gene Maddaus Senior Media Writer “Rust” armorer Hannah Gutierrez Reed has claimed that the judge in her involuntary manslaughter trial made six errors, warranting reversal of her conviction in the death of cinematographer Halyna Hutchins. Gutierrez Reed, 27, is serving an 18-month sentence at the Western New Mexico Correctional Facility in Grants, N.M. In a filing to the state’s Court of Appeals on Wednesday, defense attorney Jason Bowles cited issues with the jury instructions and the judge’s decision to allow “lay opinions” on Gutierrez Reed’s conduct as an armorer.

Prosecutors are trying to force Rust armorer Hannah Gutierrez-Reed to testify in Alec Baldwin‘s upcoming involuntary manslaughter trial.
