Kat Von D wins copyright lawsuit over Miles Davis tattoo

Miles Davis tattoo she inked a few years ago.The high-profile tattoo artist and musician faced accusations of copyright infringement back in 2021, when she was sued by photographer Jeffrey Sedlik after tattooing a portrait of the iconic jazz artist, Miles Davis.According to the lawsuit, Sedlik claimed that the portrait inked by Von D in 2017 constituted a copyright infringement of an image he took of the musician back in 1989 – taken as part of a cover story for JAZZIZ magazine. Now, nearly three years after the suit was first raised, Von D has won the case and has been cleared of any allegations of infringement. This came as a jury ruled that a tattoo reproduction of the photo did not violate copyright.“This case should never have been brought [forward],” Kat Von D’s lawyer told The New York Times on Friday (January 26).

The 51-year-old Columbian beauty stopped by Clarkson’s daytime talk show on Wednesday and discussed morphing into the real-life Griselda Blanco, a Colombian cartel leader known as “The Black Widow.”“This is incredible,” Clarkson, 41, said of Vergara’s makeover. “I feel like they only changed your nose or something.”“What?” Vergara loudly asked the “American Idol” alum.

Kelly Osbourne Admits ‘I Was a Self-Righteous C—‘ for That ‘If You Kick Every Latino Out of This Country’ Comment: ‘Worst Thing I’ve Ever Done’

Zack Sharf Digital News Director Kelly Osbourne earned backlash in 2015 when a comment she made on “The View” was widely slammed as racist. Osbourne was addressing Donald Trump’s policy on immigration at the time alongside hosts Whoopi Goldberg and Rosie Perez when she said, “If you kick every Latino out of this country then who is going to be cleaning your toilets, Donald Trump?” She later acknowledged her “poor choice of words,” but stressed: “I will not apologize for being racist as I am NOT.” The clip of Osbourne saying “If you kick every Latino out of this country” has now reemerged on TikTok and become its own meme, with users spouting their own ridiculous takes on stereotypes.

What You Need To Know About Florida’s Defamation Bill

bill asserts that claiming someone has discriminated against another person or group because of their identity will be considered “defamation per se” — meaning the accuser could find themselves facing costly legal bills for simply expressing their opinion. The bill does not appear to address what happens if the alleged discrimination is a matter of fact or public record — rather, just making an accusation of discriminatory behavior appears to be enough to land them in trouble legally.Under the bill:Under current defamation and libel laws, a subject must prove that a speaker or journalist acted with “actual malice.”This typically makes it harder for public figures, such as celebrities, to sue for defamation or libel, as they must prove the person they are suing either knew the information wasn’t true or demonstrated “reckless disregard” for its falsity. But now those in the public eye who find themselves accused of discrimination have nothing to fear — because the bill redefines what constitutes a “public figure.”The bill also eliminates the requirement that a person accused of discrimination prove their accuser acted with “actual malice” in cases where “the allegation does not relate to the reason for his or her public status.”Essentially, it means that it’s more likely that anyone making an accusation alleging discrimination will be found guilty and fined when the case goes to court. As reported by The New Republic, a person may not be considered a “public figure,” even in a limited context, if their fame or notoriety stems from:For example, if the bill becomes law, a podcaster who rants about gay marriage and calls LGBTQ people “diseased,” “perverse,” or makes other disparaging remarks could sue any person or entity
