Johnny Depp has suffered a loss ahead of the long-delayed trial for his libel lawsuit against ex-wife Amber Heard and this loss has set up a defense strategy for her legal team.
The 58-year-old actor is suing Amber for libel in Virginia, alleging that the op-ed she wrote for the Washington Post falsely implies that he physically and sexually abused her during their marriage.
The Associated Press reported on Thursday (March 24) that Johnny‘s lawyers were seeking a ruling that Amber “could not invoke a Virginia law in her defense designed to protect people from nuisance lawsuits when they speak about matters of public concern.”

Depp‘s lawyer said that the law should not be used in private disputes, but Heard‘s lawyer said that the op-ed article didn’t even mention the actor by name and it addresses the issue of preventing domestic violence, which is of public concern.
The judge ruled in favor of Amber and will allow her team to use the defense strategy that she should be protected from the libel lawsuit because her op-ed article dealt with a matter of public interest.
The AP piece notes that the judge’s “ruling does not mean Heard has immunity for what she wrote, but simply that she can make that argument to a jury as part of her defense.”
