As the song theft legal battle over Taylor Swift’s ‘Shake It Off’ continues to go through the motions, her legal team are keen to block two of the plaintiffs’ expert witnesses and limit the testimony of a third. The experts, you see, lack expertise.
Or so say Team Swift. This all relates to the US lawsuit being pursued by songwriters Sean Hall and Nathan Butler, who reckon Swift’s 2014 hit rips off their 2001 song ‘Playas Gon Play’. The latter song, recorded by 3LW, includes the lyric “the playas gon play/them haters gonna hate”, while ‘Shake It Off’ famously includes the line “the players gonna play, play, play, play, play/and the haters gonna hate, hate, hate, hate, hate”.The Swift side initially got the lawsuit dismissed on the basis lyrics about players playing and haters hating were too generic to be protected by copyright in isolation.
But the litigation was reinstated by the Ninth Circuit appeals court, and subsequent efforts to get it dismissed a second time – mainly based on the same arguments as before – have been unsuccessful. With the whole matter now heading to trial, Swift’s lawyers have submitted new court papers taking issue with some of the expert witnesses that Hall and Butler’s team intend to call. In a bid to have those experts’ testimonies cut back or cut entirely, the Swift side either question each expert’s credentials, or take issue with things they have said in depositions that occurred or documents that were submitted during the discovery phase of this case, or both.Among the three targeted witnesses is Loren Kajikawa, a Professor at George Washington University and one of those musicologists that pop up in song theft disputes of this kind.

in a TikTok video posted, naturally, at the stroke of midnight.Having previously only revealed that there were 13 tracks on “Midnights,” the 11-time Grammy winner debuted “Midnights Mayhem With Me” as a way to roll out the song titles with a lottery-style cage containing balls marked 1 through 13.“I know I have a habit of dropping cryptic clues and Easter eggs when giving you information about new music, and I’m not here to deny that — I’m here to defy that,” she says in the TikTok. “Welcome to a series I’m calling ‘Midnights Mayhem With Me.’ I am going to be using this technologically advanced device to help me allow fate to decide exactly what tracks titles I’m going to be announcing and in what order.”The 32-year-old entertainer then draws the first ball from the cage, and it just so happens to be for Track 13 — which any good Swiftie knows is Tay Tay’s lucky number.“The first track I’m going to tell you about is Track 13, because, of course,” says Swift, who then picks up a red phone and reveals that “Track 13 is called ‘Mastermind.’ ”And that title tease is all that eager fans get for now, and they will need to calm down and wait for what will presumably be 12 more videos — which are sure to be dropped at the witching hour — before getting the full track listing for “Midnights.”But Swift wasn’t playing it so coy when she accepted her Songwriter-Artist of the Decade honor at the Nashville Songwriter Awards, which took place at Music City’s Ryman Auditorium on Tuesday night.“Writing songs is a calling, and getting to call it your career makes you very lucky,” said Swift, who, of course, got her start in Nashville as a country artist.

copyright infringement lawsuit centered on ‘Shake It Off’ to be dismissed is denied, and that the trial will go ahead.US District Judge Michael W. Fitzgerald issued his decision nearly nine months after Swift’s motion to have the case dropped was put forward. In last December’s defence motion, Swift’s lawyers argued that Fitzgerald had failed to consider the “extrinsic test” – the standard whereby it’s determined if copyright is breached when two works of similar nature are presented – within songwriters Sean Hall and Nathan Butler’s claim that Swift copied lines from the pair’s 2001 song ‘Playas Gon’ Play’.Swift’s legal team believes that such a consideration would make it clear that Swift’s lyrics are based on phrases in the public domain and not, in fact, copied from Hall and Butler.“There’s a genuine issue of material fact,” Fitzgerald said upon issuing the ruling yesterday (September 12) in a hearing at a Los Angeles court [via Rolling Stone].“The motion for reconsideration is denied,” he continued.
